These General Terms and Conditions (hereafter referred to as GTC) govern the access and use of the website, as well the products and services offered by UNUA on the website (« products ») by any person («user »).
By visiting the Webiste or using any the services or applications in the website, the user accepts all the terms of this GTC.
UNUA reserves the right to adapt or modify the terms of GTC at any time. The version of the GTC applicable to any transaction is the the one published at the date and time of the visit or service use.
Through its Web Site, UNUA offers the Users several products of the brand ONI EVERYWEAR.

However, to contract any of the services offered by UNUA, users must register and accept these terms and conditions before making any payment. Consequently, placing an order by a User implies complete adherence, without reservation, to this GTC.
The User declares that has read and accepted the GTC prior to the placing an Order.
The Website is available to all Internet users and is accessible 7 days a week, 24 hours a day, subject to any interruptions, planned or unplanned, by UNUA or its providers due to technical maintenance and/or security reasons or any cases or circumstances outside of its control.

2. DATA USAGE, ORDERS AND TERMS OF SALE

In order to acquire the products offered on the Web Site, the User will need to register by filling in the registration form available on the Web Site.
The User shall be responsible for keeping the confidentiality of the data and information provided and for limiting the access to his or her computer and access keys in order to prevent any non-authorized uses.
If the User has reasons to believe that his or her data have been made available to a third party, or that they have been or may be used without his or her authorization, the User must inform UNUA immediately.
The User shall verify that his or her data are correct and inform UNUA in case of a variation and/or amendment in the information provided during the purchasing process.

The purpose of the offering of products and services through this Website is the purchase of products of the brand ONI EVERYWEAR
offered for sale at the time of consulting the Website. From ONI EVERYWEAR Website, UNUA will send orders to anywhere in the world.
UNUA does its upmost to guaranty that the quality of the photographs on the Website give a true representation of its products. Due to digital representation of images on the internet, it could occur that the presentation of the product does not conform to its photographic representation, this is a fact that the customer must understand and hereby accept. Due to the nature of several products that area handmade one by one, they could present minor changes from one unit to another.

To place any orders through the Web Site, the User must previously fill in a purchase form. The data included in said purchase form are necessary to manage your purchase order.

3. PRICES, PAYMENTS AND DISCOUNT CODES
Upon completion of the form, the User shall pay the order using the means of payment methods presented and specified on the Web Site at the purchase time.
Once the payment has been made, the User will receive an email confirming the order. This email will include a summary of the articles acquired, the type of delivery requested and the address for delivery.
If there is any problem at the time of payment which prevents same, the User will receive an automatic message indicating the existence of a payment error. Your order will not be processed until full completion of the payment.
The prices of the services are stated in Euros (€) and include taxes and handling and delivery expenses, the amount of which shall be specified at the time of final confirmation of each order.
UNUA may offer discount codes to its Users. These discounts may only be applied as per the instructions specified by UNUA for each code and, in any event, only one code may be used per order.

UNUA has the right to change the price of any and all of its products at any time.

4. ORDERS CANCELLATION & RETURNS
​
Due to the nature of made to order, customized and made-to-measure products presented in the Website, and the fact that they have been specially created for the User, we will not be able to accept cancellations, exchanges or returns.

Customers will be able to return any ONI EVERYWEAR product to UNUA, without any cost, that presents a defective production that does not comply with the customization options ordered by the User. This complaint should be made during a period of 30 days from the date in which the product was received.
User must indicate the order and the product or products, attaching photographs and other evidence showing the differences from the orders options , as well as a detailed list of the differences found, the purchase order and any other additional documentation that identifies the purchase made by the User.

Once UNUA has received communication from the customer and has analyzed the issue through its Quality Department, we will notify you as soon as possible whether or not the product can be returned, objectively addressing the nature of the product or the nature of the alleged erros.
Depending on the error found, UNUA will offer one of 3 solutions:
- total refund of order amount (shipping not included)
- a percentage of the product order amount for customer to make corrections with a local provider
- a return of the product to be corrected or produced accordingly to irder specifications.

If the return is deemed necessary, UNUA will notify the customer on how to send the product to their warehouses.
​
UNUA is not responsible for shipping costs that may incur regarding the return/exchange of a product.
​
Complaints about defective products, will be managed under the scope of warranty general terms described below.
5. CUSTOMS AND DUTIES
​
Any Customs Tax and Duties and any other form of taxes (except the European VAT,) are not included in the prices quoted on the website. These taxes, when they apply, must be paid by the customer directly to the courier or customs.

6. FRAUD ATTEMPT
​
In the event of non-compliance by a customer with the obligations under the GTC, and particularly in case of fraud or any attempt to fraud, and any incident of payment of the price of the Order, UNUA reserves the right to refuse any order from the customer.
UNUA may suspend or cancel any execution and / or delivery of an Order, whatever its nature and level of execution, in the event of non-payment or partial payment of any sum due by the Customer to UNUA, in case of a payment incident.
The data recorded by UNUA is kept and serves as proof of any financial orders or transactions.

7. DELIVERY
​
As our products are made to order and need to be produced prior to delivery will be given a estimation date for delivery accordingly to production time frames.

Deliveries will be processes from Monday to Friday from Portugal.
Shipping Costs
PORTUGAL and SPAIN: Deliveries to Portugal and Spain will be free of charge.
EUROPE and REST OF THE WORLD: shipping costs varies by destination country and order package volume. Respective cost will be presented to User at checkout phase.
In certain counties outside of Europe additional taxes or custom duties may apply and these must be paid by the customer.

The deliveries will be made to the address indicated by the customer, therefore extra careful care must be taken to make sure that the information provided is correct. Special care must be taken when filling in the address (building, floor, house number, stairs, access code, name or number of the intercom etc.).

The delivery times on the Website are given as an estimate and only correspond to the average time needed for possessing and delivery.

UNUA cannot be held responsible or liable for any direct or indirect damages resulting from delays or damages due to delivery by courier.
8. WARRANTY

All UNUA products are warranted for 2 years from the order date of purchase against manufacturer defects. Coverage is valid only with the proof of purchase (original receipt) from UNUA . Alteration of products will void warranty. Scratched items or other wear and tear as a result of normal use are not covered by this warranty.
Certain conditions may invalidate warranty coverage including but not limited to:
• Excessive wear; Visible scratches; Warped materials from exposure to extreme heat or wrongly cleaning processes
• Any type of abuse or mistreatment

These elements belong to UNUA or they are used with the agreement of their owners.
Any use by the or reproduction of the company names, marks and distinct signs belonging to the Company is strictly prohibited except in the case of prior express agreement with UNUA.
It is strictly forbidden to reproduce (except for personal and non-commercial use), publish, edit, transmit, distribute, display, remove, delete, and add to this Website and the elements and software contained.

10. APPLICABLE LAW

All purchases made on the website www.onieverywear.pt are subject to Portuguese legislation. Regardless of where you access this site, you agree that any action at law or in equity arising out of or relating to these GTC shall be filed and adjudicated only to the Court District of Lisbon, Portugal, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction and venue of such courts over any suit, action or proceeding between you and UNUA or any of its affiliates.
